In 1870, Newcomb moved to Texas and from 1871-1874 served as the judge of the 25th Judicial District of Texas. Newcomb moved to Las Cruces, New Mexico in 1875, where he was a law partner of Herbert B. Holt, and one of the founders of the Las Cruces College (now New Mexico State University).
